Rental Agreement and Liability Waiver
Your celebration's safety is our priority, please review and complete this waiver to finalize your booking.
The Renter acknowledges that they are renting one or more items from Amery Party Packs & Rental Services, which may include but are not limited to soft play equipment, bounce castles or inflatables, bubble houses, dome play structures, merry-go-round carousel equipment, ball pits, children’s tables and chairs, or other party rental equipment. All equipment will be delivered in good working condition and must be returned in the same condition, normal wear and tear excepted.
1. Soft Play & Party Entertainment
Equipment Covered
This section applies to all soft play and party entertainment equipment provided by Amery Party Packs & Rental Services, including but not limited to:
- Soft Play Sets
- Ball Pits and Ball Pit Balls
- Safety Mats
- Safety Gates/Fencing
- Soft Play Blocks
- Bridge Climber
- Toddler Slides
- Slide & Tunnel Sets
- Rockers
- Animal Hoppers
- Ride-On Cars
- Mini Bounce Houses
- Bubble Dome/Bubble House
- Bumper Cars, Remote Controls, Charging Equipment, and Inflatable Arena
- Carousel
- Air Blowers, Extension Cords, Tarps, Anchors, and other accessories supplied with the equipment
- Any other soft play or children's entertainment equipment supplied by Amery Party Packs & Rental Services.
Supervision
An adult (18 years or older) must supervise all children using the equipment at all times. The Renter is responsible for ensuring that all participants use the equipment safely. Amery Party Packs does not provide supervision services and assumes no responsibility for monitoring participants.
Equipment Care & Responsibility
The Renter agrees to maintain all equipment in good condition and ensure it is used only for its intended purpose. Food, drinks, shoes, face paint, slime, confetti, glitter, gum, pets, sharp objects, and any other materials that may damage or stain the equipment are strictly prohibited.
The Renter is responsible for ensuring that all equipment, components, and accessories supplied with the rental are present and returned at pickup. Missing or damaged items may result in additional replacement or repair charges.
Ball Pit Balls
All ball pit balls must be returned to the ball pit after play and before our pickup team arrives. The Renter is responsible for ensuring that all balls are collected from the play area and placed back into the ball pit. If our team is required to collect balls scattered throughout the play area or venue, a $25 cleanup fee will be charged to cover the additional labour and time required for collection.
Pickup Readiness
The Renter agrees to ensure that all rental equipment is accessible, and ready for pickup at the agreed collection time. This includes returning all ball pit balls to the ball pit, removing personal belongings, and ensuring clear access to the equipment. Additional labour or waiting time charges may apply if our pickup team experiences delays due to the equipment not being ready for collection.
Weather & Safety Conditions
For outdoor events, the Renter agrees that equipment will not be used during unsafe weather conditions including strong winds, heavy rain, or storms. If unsafe weather occurs, equipment must be turned off or discontinued for safety reasons.
2. Other Rental Items
Equipment Covered
This section applies to all other rental items supplied by Amery Party Packs & Rental Services, including but not limited to:
- Kids' Tables and Chairs
- Adult Tables and Chairs
- Backdrops and Stands
- Balloon Stands and Arches
- Champagne Walls
- Easel Stands
- Dessert and Cake Stands
- Snack/Display Carts
- Chafing Dishes
- Drink Dispensers
- Any accessories supplied with the rental items
- Any other rental equipment supplied by Amery Party Packs & Rental Services.
Care & Responsibility
The Renter agrees to use all rental items for their intended purpose and exercise reasonable care at all times. The Renter is responsible for any loss, theft, damage, misuse, excessive cleaning, or missing accessories. Additional charges may apply for repair, replacement, or cleaning as necessary.
Return Period
Unless otherwise agreed in writing, customer pickup rentals are for 24 hours, with an additional 24-hour grace period for return. All rental items must be returned on or before 12:00 noon on the second day following pickup.
Rental items not returned by the agreed return time will be subject to a late fee equal to one full day’s rental rate for each additional day or portion thereof. Failure to return rental items may also result in forfeiture of the security deposit, and the Renter will be responsible for any replacement costs for lost or unreturned items.
3. Security and Damage Deposit
A refundable security deposit may be required prior to delivery. The deposit serves as protection against damage, loss, or excessive cleaning requirements. The deposit will be returned once the equipment is inspected and confirmed to be in the same condition as delivered. If equipment is damaged, excessively dirty, lost, or misused, the cost of repair, replacement, or cleaning may be deducted from the deposit. If damages exceed the deposit amount, the Renter agrees to pay the remaining balance required to restore or replace the equipment.
4. Assumption of Risk
The Renter understands that recreational play equipment involves inherent risks including but not limited to slips, falls, collisions between participants, and minor injuries. By signing this Agreement, the Renter voluntarily assumes all risks associated with the use of the rental equipment for themselves and for all participants, including children and guests attending the event.
5. Liability Release and Waiver
To the fullest extent permitted by law, the Renter agrees to release, waive, and discharge Amery Party Packs & Rental Services, its owners, employees, contractors, and representatives from any and all claims, liabilities, damages, or causes of action arising out of or related to the use of the rental equipment. This includes claims relating to personal injury, property damage, accidents, or any loss sustained during the rental period.
6. Legally Binding Agreement
By signing this document, the Renter acknowledges that they have carefully read and fully understand the terms of this Agreement. The Renter further agrees that this Agreement is legally binding upon themselves, their family members, guests, and all participants using the equipment.
The Renter acknowledges that typing or signing their name electronically constitutes a valid and legally binding digital signature with the same legal effect as a handwritten signature.
