Rental Agreement and Liability Waiver
Your celebration's safety is our priority, please review and complete this waiver to finalize your booking.
The Renter acknowledges that they are renting one or more items from Amery Party Packs & Rental Services, which may include but are not limited to soft play equipment, bounce castles or inflatables, bubble houses, dome play structures, merry-go-round carousel equipment, ball pits, children’s tables and chairs, or other party rental equipment. All equipment will be delivered in good working condition and must be returned in the same condition, normal wear and tear excepted.
Adult Supervision Requirement
For all customer pickup rentals (including but not limited to cake stands, snack carts, champagne walls, chafing dishes, tables, chairs, and other portable equipment), the Renter agrees to the following:
- The Renter agrees that a responsible adult must supervise children at all times while the equipment is in use. Amery Party Packs & Rental Services does not provide supervision services and assumes no responsibility for monitoring participants.
- The Renter agrees to ensure that all children use the equipment safely and responsibly. The Renter further agrees to enforce the following safety rules: no shoes on soft play equipment, no food or drinks on equipment, no gum, candy, slime, or face paint on equipment, no sharp objects or toys that may damage equipment, and no rough play, pushing, or unsafe behavior.
Rental Period, Return Time & Late Fees (Customer Pickup Rentals)
For all customer pickup rentals (including but not limited to cake stands, snack carts, champagne walls, chafing dishes, tables, chairs, and other portable equipment), the Renter agrees to the following:
- The standard rental period is 24 hours, unless otherwise agreed in writing.
- A grace period of up to 24 additional hours may be allowed.
- All items must be returned no later than 12:00 PM (noon) on the second day (48 hours total) unless prior approval is given.
Failure to return equipment within the agreed timeframe will result in additional charges as follows:
For all customer pickup rentals (including but not limited to cake stands, snack carts, champagne walls, chafing dishes, tables, chairs, and other portable equipment), the Renter agrees to the following:
- The Renter will be charged the full rental rate for each additional day (or part thereof) that the equipment is not returned.
- Late returns beyond the grace period may result in forfeiture of the security deposit, at the Company’s discretion.
- If the equipment is not returned within the agreed timeframe and communication is not maintained, Amery Party Packs & Rental Services reserves the right to treat the equipment as lost or withheld, and the Renter will be responsible for the full replacement cost of the item(s).
- In such cases, the Company also reserves the right to take further action, including reporting the matter to the appropriate authorities and pursuing recovery or compensation as permitted by law.
Assumption of Risk
The Renter understands that recreational play equipment involves inherent risks including but not limited to slips, falls, collisions between participants, and minor injuries. By signing this Agreement, the Renter voluntarily assumes all risks associated with the use of the rental equipment for themselves and for all participants, including children and guests attending the event.
Liability Release and Waiver
To the fullest extent permitted by law, the Renter agrees to release, waive, and discharge Amery Party Packs & Rental Services, its owners, employees, contractors, and representatives from any and all claims, liabilities, damages, or causes of action arising out of or related to the use of the rental equipment. This includes claims related to personal injury, property damage, accidents, or any loss sustained during the rental period.
Equipment Care and Responsibility
The Renter agrees to maintain the equipment in good condition and ensure that it is used only for its intended purpose. The Renter is responsible for preventing misuse, abuse, or negligent use of the equipment and must ensure that prohibited substances or objects do not come into contact with the equipment.
Security and Damage Deposit
A refundable security deposit may be required prior to delivery. The deposit serves as protection against damage, loss, or excessive cleaning requirements. The deposit will be returned once the equipment is inspected and confirmed to be in the same condition as delivered. If equipment is damaged, excessively dirty, lost, or misused, the cost of repair, replacement, or cleaning may be deducted from the deposit. If damages exceed the deposit amount, the Renter agrees to pay the remaining balance required to restore or replace the equipment.
Weather and Safety Conditions
For outdoor events, the Renter agrees that equipment will not be used during unsafe weather conditions including strong winds, heavy rain, or storms. If unsafe weather occurs, equipment must be turned off or discontinued for safety reasons.
Legally Binding Agreement
By signing this document, the Renter acknowledges that they have carefully read and fully understand the terms of this Agreement. The Renter further agrees that this Agreement is legally binding upon themselves, their family members, guests, and all participants using the equipment.
The Renter acknowledges that typing or signing their name electronically constitutes a valid and legally binding digital signature with the same legal effect as a handwritten signature.
